The Ministry of Human Resources and Emiratisation stressed the necessity of providing 3 conditions that establishments abide by in the event that the worker is assigned to them for work other than the nature of his work, in a manner that preserves the right of the two parties to the work contract, in accordance with the Law on Regulating Labor Relations and its Executive Regulations.
She explained that the conditions that work establishments adhere to, include that the work assigned to the worker is other than the nature of his work for necessity, or to prevent an accident, or to repair damage caused by the worker, provided that the temporary assignment is for a maximum period of 90 days, and is done with the written consent of the worker. The facility shall bear all expenses resulting from this assignment, which are the transportation, accommodation and other allowances.
The ministry clarified the procedures that must be followed when a worker suffers a work injury or an occupational disease, which are: informing the medical authority, informing the competent police station, and informing the ministry within 48 hours as a maximum.
The ministry indicated 4 steps to obtain a work permit for a worker from outside the country, including: submitting the application through one of the service channels, the application is transmitted electronically to the ministry for review, and then notifying the applicant to complete the deficiencies, if any, and upon approval, the fees are paid with the attached job offer approved by the worker .
The ministry stated how to lift the restriction on establishments in the event of an error in salary transfer, by submitting a request for a service adjustment of the salary period through the approved service centers: businessmen service centers, delivery, or facility facilitation system, and if the ban continues on the facility despite its payment of wages, Submit a technical support request with the proof attached.
The Ministry of Human Resources and Emiratisation called on employers to commit to paying workers’ wages on their due dates, and as agreed upon in the work contract, through the wage protection system; Which contributes to increasing the productivity of workers and stabilizing the contractual relationship between its two parties.
Mohsen Al-Nassi, Acting Assistant Undersecretary for Inspection Affairs at the Ministry of Human Resources and Emiratisation, explained that the commitment of employers to pay wages, in accordance with the legislation regulating labor relations, would contribute significantly to building balanced and stable relations between the two parties to this relationship, which is governed by the law regulating labor relations. Labor relations, its executive regulations and ministerial decisions.
He said that the mechanism of work of the wage protection system enables employers to fulfill their obligations towards their workers in the easiest and easiest way, through a strategic partnership with the Central Bank of the Emirates.
He added that the worker getting his wages is one of the rights that the employer must abide by, as he is considered late in paying the wage if he does not pay it to the worker within the first fifteen days of the due date, unless it is stipulated in the work contract for a shorter period.
Al-Nassi confirmed the application of administrative procedures against establishments that did not adjust their conditions during the past period, in accordance with what is required of them, according to the periods of delay in payment, the size of the facility, and the number and percentage of unpaid workers.
