Cabinet decision on reviewing the financial rights of workers and employees

The Ministry of Human Resources and Emiratisation announced the establishment of a committee to look into collective labor disputes related to the financial rights of workers whose number exceeds 50 workers and which cannot be settled amicably between the two parties to the relationship, in implementation of a decision issued by the Council of Ministers in this regard, which attached the subordination of the committee to the Ministry.

Acting Undersecretary for Human Resources Affairs Khalil Khoury said that the decision to establish the committee comes within the framework of strengthening the legislative and organizational structure of labor disputes in line with the Law on Regulating Labor Relations and its Executive Regulations, and in a manner that guarantees the rights of both parties to the dispute in a balanced manner, in parallel with the speedy settlement of collective labor disputes. And support the stability of the labor market, taking into account the impact of this type of disputes on the facility.

The Ministry of Human Resources and Emiratisation chairs the committee, which includes in its membership representatives of the relevant authorities, who are a judge with the rank of chief appeal, a representative of the Chamber of Commerce and Industry, another from the local labor committee or from the labor crisis team in the emirate within the spatial jurisdiction of the dispute, in addition to a representative from the Department of Human Resources and Emiratisation. The Acting Undersecretary for Human Resources Affairs affirmed the consolidation of the principle of impartiality, integrity and transparency in the work of the committee, in light of the composition of its members, and its mechanism for considering the collective work dispute referred to it, including the presence of representatives of the workers and the employer, as well as hearing witnesses.

And summon whomever the committee deems appropriate to settle the dispute, indicating that the two parties to the dispute have the opportunity to deposit a defensive memorandum accompanied by documents supporting the pleas within at least three days from the date of notification of the date of the hearing.

Khoury explained that according to the decision to establish the committee, it takes its decision regarding the dispute presented to it within a maximum period of 30 days from the date of the first session, in preparation for referring this decision to the competent enforcement department.

The decision of the Council of Ministers allowed the committee to request the liquidation of the bank guarantees, and the disbursement of the value of the insurance coverage, to protect the rights of the workers party to the dispute, and to address any impact of the collective labor dispute referred to the committee.
