Dubai Traffic Court has sentenced a driver of African nationality to a AED 5,000 fine and a three-month suspension of his driving license, after proving his involvement in multiple serious traffic violations, including damage to others’ property. The court applied legal leniency in accordance with applicable laws.

The case dates back to an incident in which the defendant was driving a vehicle with expired registration and no valid insurance on Ras Al Khor Road, heading toward Sheikh Mohammed bin Zayed Road. The driver failed to take necessary precautions or consider road conditions, leading to a traffic collision with another vehicle and resulting in damage to both cars.

According to official police reports and inspection records, the defendant admitted responsibility for the accident. The court confirmed the incident through investigations, statements from the affected party, and supporting evidence, including on-site inspection reports, traffic accident analysis, and the accident’s schematic diagram, all of which established the defendant’s liability.

The court noted that the defendant failed to attend the trial session despite being legally notified, prompting the issuance of an in absentia ruling, in accordance with the UAE Federal Criminal Procedure Law.

In its reasoning, the court stated that the violations constituted an integrated criminal act, as the offenses of damaging others’ property, driving an unregistered vehicle, and operating a vehicle without insurance were interconnected and could not be treated separately. Accordingly, the court ruled that the penalty applicable to the most serious offense should be enforced.

The ruling was based on Federal Law No. 31 of 2021 on Crimes and Penalties, the UAE Traffic Law, and Ministerial Resolution No. 178 of 2017, which regulates traffic enforcement procedures and penalties.

As part of the judgment, the court imposed a AED 5,000 fine, suspended the defendant’s driving license for three months starting from the date the ruling becomes final, and held him accountable for all consequences of the incident. While considering the act a single criminal offense warranting the harshest penalty, the court exercised leniency within the limits prescribed by law.
